These Terms & Conditions (“Terms”) govern registration, membership, payment and use of the matchmaking and connection services provided by NKK Divine Connections Global (“NKK Divine Connections Global”, “we”, “us” or “our”).

By registering with us, submitting a membership application, making payment, upgrading a membership or using our services, you acknowledge that you have read, understood and accepted these Terms.

NKK Divine Connections Global provides professional matchmaking and connection-facilitation services to adults seeking companionship, relationships and/or marriage.

Our services may include:

• Member registration and profile creation;
• Profile assessment;
• Compatibility assessment;
• Matchmaking and partner identification;
• Local, national and international connections;
• Communication and member support;
• Access to features associated with the member's selected package; and
• Other matchmaking-related services communicated to the member at the time of joining or upgrading.

Our service is a facilitation and matchmaking service and not a guarantee of a relationship or marriage.

NKK Divine Connections Global may offer different membership levels, including:

Standard Membership provides the services and benefits expressly communicated for the Standard package at the time of purchase.

Premium Membership provides the additional matchmaking and connection benefits expressly communicated for the Premium package at the time of purchase.

Prestige Membership provides the enhanced matchmaking and connection benefits expressly communicated for the Prestige package at the time of purchase.

Elite Membership provides the extended-period and enhanced matchmaking services expressly communicated for the Elite package at the time of purchase.

The exact benefits, duration, number of potential introductions, geographical scope and other features applicable to each package shall be those communicated to the member at the time of purchase or upgrade.

NKK Divine Connections Global reserves the right to modify package features from time to time for future purchases. Such changes will not retrospectively alter benefits already purchased unless required by law or agreed with the member.

A paid membership is considered activated when payment has been successfully received and NKK Divine Connections Global has commenced the process of providing the purchased service.

Activation may involve immediate operational activities including:

• Account creation or activation;
• Profile processing;
• Profile assessment;
• Compatibility analysis;
• Matchmaking database processing;
• Searching and reviewing potentially compatible profiles;
• Member support;
• Communication and administrative processing;
• Technology and platform resources; and
• Other resources required to provide the purchased membership.

Operational work may therefore begin immediately after payment and before a member receives an actual connection.

Because NKK Divine Connections Global incurs operational, technology, administrative, matchmaking and support costs immediately when a paid membership is activated, membership fees are non-refundable once the membership has been activated and operational services have commenced, subject to any rights that cannot legally be excluded.

This applies to:

Standard | Premium | Prestige | Elite

A member's subsequent decision not to use the service does not automatically create an entitlement to a refund.

A member will not ordinarily be entitled to a refund merely because the member:

• Changes their mind;
• Stops responding to our communication;
• Does not log into their account;
• Does not communicate with an introduced member;
• Decides not to pursue a particular connection;
• Changes their relationship preferences;
• Relocates to another country or city;
• Becomes unavailable for personal reasons;
• Finds a partner independently;
• Decides that they no longer require matchmaking services; or
• Does not use all features available under their membership.

Once the service has been activated, the operational resources allocated to the membership may already have been consumed or committed.

A member's dissatisfaction with the characteristics, location, age, profession, personality, preferences or other attributes of a potential match does not automatically create a refund entitlement.

Matchmaking depends upon the information available, member preferences, compatibility factors, geographical availability and the participation of other members.

Payment purchases access to the applicable matchmaking service.

Payment does not purchase a guaranteed:

• Relationship;
• Marriage;
• Engagement;
• Number of successful relationships;
• Acceptance by another member;
• Particular individual as a partner;
• Specific geographical outcome; or
• Particular timeframe for finding a partner.

Our responsibility is to provide the matchmaking service included in the selected membership, not to guarantee the personal decisions or responses of another member.

Nothing in these Terms is intended to remove, restrict or waive any consumer, statutory or other legal right that cannot lawfully be excluded.

Where applicable law requires a cancellation, refund, remedy or other consumer protection, NKK Divine Connections Global will comply with that legal requirement.

Where a member believes that a payment was duplicated, processed incorrectly, unauthorised or otherwise requires review, the member should contact us promptly with the relevant payment information.

Where a membership has a specified validity period, the membership shall remain available for the stated period communicated at the time of purchase.

Unused membership time or benefits do not automatically convert into cash or create a refund entitlement after expiry.

Where NKK Divine Connections Global voluntarily extends a membership as a customer-service gesture, such extension does not establish a continuing right to future extensions.

NKK Divine Connections Global uses information supplied by members to identify potentially compatible individuals.

Compatibility results are based on the information available to our systems and/or matchmaking methodology.

We do not represent that a compatibility assessment constitutes a scientific, psychological, medical or professional certification of compatibility.

A compatibility score or recommendation should be regarded as a matchmaking aid and not a guarantee of relationship success.

Members must provide information that is truthful, accurate and not intentionally misleading.

Members should promptly update material changes to their:

• Name;
• Age;
• Relationship status;
• Location;
• Contact details;
• Relationship preferences; and
• Other information that may materially affect matchmaking.

We reserve the right to suspend or review a profile where information appears materially false, fraudulent or misleading.

Members are responsible for exercising appropriate caution when communicating with or meeting another member.

We strongly advise members to:

• Verify the identity of people they meet;
• Avoid sending money to people they meet through the service;
• Never share passwords or account credentials;
• Avoid disclosing unnecessary financial information;
• Meet in safe public places when meeting for the first time;
• Inform a trusted person about planned meetings; and
• Report suspicious or abusive behaviour to NKK Divine Connections Global.

NKK Divine Connections Global does not authorise members to request money, loans, investments or financial assistance from other members as a condition of pursuing a relationship.

Members must not use our platform or services to:

• Defraud or scam another person;
• Impersonate another person;
• Harass, threaten or intimidate another member;
• Discriminate against or publicly expose another member;
• Publish another member's private information without permission;
• Distribute another member's photographs without appropriate permission;
• Obtain money through deception;
• Engage in unlawful activities;
• Circumvent membership restrictions;
• Create multiple fraudulent accounts;
• Use the service for commercial solicitation without permission; or
• Deliberately provide materially false information.

Where we reasonably believe that a member has breached these Terms or presents a significant risk to other members, we may suspend, restrict or terminate the account.

Some members may voluntarily provide HIV status or other health-related information for matchmaking purposes.

Such information is treated as sensitive and confidential.

Members must not use another member's health information to:

• Harass;
• Shame;
• Threaten;
• Blackmail;
• Discriminate against;
• Publicly identify; or
• Otherwise harm that person.

NKK Divine Connections Global will handle personal information in accordance with its Privacy Policy and applicable data-protection requirements.

Our collection and processing of personal information is governed by our Privacy Policy.

Members acknowledge that information voluntarily disclosed directly to another member may subsequently be outside NKK Divine Connections Global's control.

Members should therefore exercise care when choosing what information, photographs, documents or contact details to share with another person.

NKK Divine Connections Global facilitates connections between members but does not control private conversations between members.

A member's decision to continue communicating with another member is voluntary.

We are not a party to private agreements, financial transactions, relationship arrangements, travel arrangements or other private dealings between members.

The introduction of one member to another does not constitute an endorsement of that person's:

• Financial position;
• Employment;
• Business;
• Immigration status;
• Family circumstances;
• Relationship intentions;
• Character; or
• Ability or willingness to provide financial support.

Members should conduct their own independent verification where appropriate.

Members are responsible for photographs, descriptions and other information they submit to their profile.

Members must not submit content that:

• Belongs to another person without permission;
• Is fraudulent or deceptive;
• Violates another person's privacy;
• Is unlawful; or
• Is intended to harm or mislead another member.

Where a member voluntarily provides material for matchmaking purposes, the member grants NKK Divine Connections Global the limited permission necessary to use that material to provide the requested service, subject to our Privacy Policy.

Members are responsible for maintaining the confidentiality of their login credentials.

A member must immediately notify NKK Divine Connections Global if they suspect unauthorised access to their account.

We will take reasonable steps to protect our systems but cannot guarantee that an internet-based service will be completely immune from security incidents.

We endeavour to maintain reliable access to our website and services.

However, temporary interruption may occur because of:

• Website maintenance;
• Internet failures;
• Hosting failures;
• Payment-provider interruptions;
• Third-party technology failures;
• Cybersecurity incidents;
• Force majeure events; or
• Other circumstances beyond our reasonable control.

Temporary technical interruption does not automatically constitute a failure to provide the overall membership service.

Our services may rely on third-party providers, including payment processors, hosting providers, communication platforms, analytics providers and other technology providers.

Where appropriate, third-party services may be subject to their own terms and privacy policies.

NKK Divine Connections Global may suspend, restrict or terminate a membership where a member:

• Breaches these Terms;
• Provides materially false information;
• Engages in fraud or suspected fraudulent activity;
• Harasses or threatens another member;
• Misuses sensitive personal information;
• Attempts to compromise our systems;
• Creates a safety risk for other members; or
• Uses the service for an unlawful or prohibited purpose.

Where termination results from a member's misconduct, the member will not ordinarily be entitled to a refund for an activated membership, subject to applicable law.

The NKK Divine Connections Global name, logo, website design, written content, graphics, systems, materials and other intellectual property are protected by applicable law.

Members may not reproduce, copy, modify, distribute or commercially exploit our intellectual property without prior permission.

NKK Divine Connections Global's role is to facilitate introductions.

We do not control the actions, statements, intentions or future conduct of individual members.

To the extent permitted by law, NKK Divine Connections Global shall not be responsible for losses arising from private decisions, relationships, transactions, travel arrangements or other dealings entered into independently between members.

Nothing in these Terms excludes liability that cannot legally be excluded.

We may improve, modify, replace or discontinue particular website features or matchmaking processes from time to time.

Where a material change affects an existing paid membership, we will seek to implement the change fairly and in accordance with applicable law.

We may update these Terms to reflect changes in our services, technology, business practices or applicable law.

The latest version published on our website will apply to future use of the services.

Where required, members will be notified of material changes.

These Terms shall be interpreted subject to the applicable laws of Kenya and any mandatory legal protections applicable to the member in the relevant jurisdiction.

Nothing in these Terms is intended to deprive a consumer of a mandatory legal right.

By completing payment for Standard, Premium, Prestige or Elite Membership, you acknowledge that membership activation may trigger immediate operational work and associated costs.

Once your membership has been activated and operational services have commenced, your membership fee is non-refundable except where a refund or other remedy is required by applicable law.

Your payment gives you access to the applicable matchmaking service. It does not constitute payment for a guaranteed relationship, marriage, particular partner or particular outcome.
